Personnel deficiencies are a consistent source of survey citations — and they carry direct patient safety implications in a setting where every staff member's role is essential to the safety of life-sustaining treatment. Overview

Personnel compliance in the ESRD setting involves three distinct categories of regulatory obligation: the qualification requirements established by the ESRD Conditions for Coverage, the state licensure requirements applicable to nursing and other licensed healthcare personnel, and the specific training and competency requirements for patient care technicians that are mandated by the conditions and by many states.

The CMS Conditions for Coverage at 42 CFR Part 494.140 establish personnel qualification requirements for each category of dialysis facility staff — including the medical director, the administrator, registered nurses, licensed practical or vocational nurses, patient care technicians, social workers, and dietitians. These requirements are specific and verifiable — and surveyors assess personnel files directly during the survey process to confirm that each staff member meets applicable qualification standards.

Personnel Compliance Areas

Medical Director Qualification and Obligation Compliance

The medical director must be a physician who is board-certified or board-eligible in nephrology. Beyond qualifications, the medical director has specific functions defined by the Conditions for Coverage — including oversight of the QAPI program, review and approval of patient care policies, clinical oversight of the facility, and specific responsibilities related to medical staff credentialing and clinical care review.

We assess both medical director qualification documentation and the documentation of medical director function performance — evaluating whether the required medical director activities are being performed and whether they are documented in a format that satisfies CMS survey requirements.

Nursing Staff Qualification Compliance

Dialysis facility nursing staff must be licensed registered nurses or licensed practical/vocational nurses in the state of practice. We verify current licensure for all nursing staff, assess license verification processes for new hires, and build ongoing license monitoring systems that identify expiring or lapsed licenses before they create compliance exposure.

Patient Care Technician Training and Competency

Patient care technicians in dialysis settings must complete a training program that meets specific requirements before functioning independently with patients. The Conditions for Coverage specify the content areas that PCT training must cover — including access care, machine operation and monitoring, infection control, patient safety, and emergency procedures — and require that competency be assessed and documented at the completion of training.

We assess PCT training program content against CMS requirements, review competency documentation for all current PCTs, and identify training or competency documentation gaps that represent compliance risk.

Social Worker and Dietitian Qualification

Dialysis facilities must have access to social work services and dietary services provided by individuals with specific educational and credentialing requirements. Continuing Education Documentation

Many states and professional associations impose continuing education requirements for licensed nursing staff and other healthcare professionals, and the Conditions for Coverage require that facilities ensure that staff maintain current knowledge of dialysis practice. We assess continuing education documentation practices and build tracking systems that maintain current CE compliance records for all applicable personnel.

OIG Exclusion Screening

Monthly screening of all employees, contractors, and vendors against the OIG exclusion list is a fundamental compliance obligation that dialysis facilities frequently manage inconsistently. We implement systematic monthly exclusion screening with documented results and remediation processes for any identified exclusions.
